Welcome to My Korean Kitchen (“we”, “us”, “our”). By accessing or using our website (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site.
These Terms incorporate our Privacy Policy, which explains how we and our service providers collect, use, store, disclose and process personal information (including cross-border transfers). By using the Site, you consent to such collection and processing as described in the Privacy Policy.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded.
1. Definitions
“Site” means the website at mykoreankitchen.com and any related sub-domains.
“Services” means any content, recipes, products or features we provide via the Site.
“User Content” means any comments, text, images, recipes, links or other material that you post or submit.
“We / Us / Our” means My Korean Kitchen.
2. Headings & Interpretation
Section titles are for convenience only and do not affect interpretation.
Words in the singular include the plural and vice versa.
3. Disclaimer – Recipes and Information
The recipes, articles, and advice on this Site are the personal opinion of the authors, and are provided for entertainment and general information only.
We do not warrant that any recipe or content is accurate, complete, reliable, suitable or free from error.
We are not liable for any loss, damage, injury, or adverse outcome arising from use of the recipes or any content on the site, to the maximum extent permitted by applicable law
It is your responsibility to check for food allergies, intolerances, ingredient suitability, and to ensure food safety for anyone consuming dishes prepared from our recipes.
The Site and all content are provided “as is” and “as available”, without warranties of any kind – whether express, implied or statutory – including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, except where such warranties cannot be excluded under law.
To the maximum extent permitted by applicable law, we are not liable for any loss, damage, injury or adverse outcome arising from your reliance on or use of the recipes, articles, or other content on the Site.
4. Age / Minors
If you are under sixteen (16) years of age – or under the age of majority in your jurisdiction – you may only use the Site with the consent and under the supervision of a parent or legal guardian.
By using the Site, you represent that you meet this age requirement.
Parents or guardians who permit minors to use the Site accept responsibility for the minor’s activities on the Site.
5. Copyright and Intellectual Property
Unless otherwise noted, all content on the Site – including text, recipes, photographs, videos, graphics, and layout – is the property of My Korean Kitchen and protected by Australian and international copyright and intellectual-property laws.
You may use limited excerpts of our posts for non-commercial purposes provided you include a clear, clickable credit link back to the original post or to our home page.
Commercial use of any content or reproduction of an image, post or page in full requires our prior written permission.
You may print or download content only for your own personal, non-commercial use.
Copyright Takedown Procedure
If you believe any content on the Site infringes your copyright, please send us a written notice including:
- your full name and contact details,
- identification of the copyrighted work claimed to have been infringed,
- the URL or description of where the infringing material appears,
- a statement that you have a good-faith belief the disputed use is not authorised by the copyright owner, its agent or the law,
- a statement under penalty of perjury that the information provided is accurate and that you are the copyright owner or authorised to act on the owner’s behalf, and
- an electronic or physical signature of the copyright owner or authorised agent.
6. Prohibited Uses
You agree not to use the Site to:
- violate any applicable law or regulation;
- infringe intellectual-property, privacy, data-protection or consumer-protection laws;
- post or transmit any unlawful, harassing, defamatory, abusive, obscene, hateful or otherwise objectionable content;
- upload malicious code or attempt to disrupt, damage, or gain unauthorised access to the Site or our servers;
- spam, phish or engage in fraudulent or deceptive activities;
- interfere with, disrupting, or creating an undue burden on the website or the networks or services connected to the site;
- use the website for any political campaigning.
- advertise to, or solicitation of, any user to buy or sell any products or services;
- transmit chain letters or junk email to other users;
- discuss topics that have no relationship to food, food-related items, or Korean culture;
7. AI / Automated Access
We welcome responsible access by search engines, AI assistants and other automated tools whose primary purpose is to help users discover or navigate our publicly available content, provided that such tools:
- Respect our `robots.txt` file, rate-limits and technical controls we may implement to protect the Site’s stability and security;
- Do not harvest or store our recipes, photos, text or other content in bulk for the purpose of re-publishing, re-packaging, or offering a competing recipe or cooking resource, whether in print, digital or machine-generated form;
- Display only limited excerpts or summaries as reasonably necessary to respond to a user’s query and link clearly and prominently back to the original page on mykoreankitchen.com for the full recipe or article;
- Do not use our content to train or fine-tune models in a way that results in systematic reproduction or substitution of our recipes, images, or brand as a commercial product or dataset, without our prior written consent.
We reserve the right to block or limit any automated access that in our judgment is abusive, interferes with the Site’s functioning, or violates these Terms.
All other uses of our content by automated tools—including bulk copying, scraping, dataset compilation or republication—require our prior written permission.
Nothing in this section limits any fair-dealing or fair-use rights that cannot be restricted by contract.
8. User Content
If you submit comments, recipes, photos, or other material (“User Content”) to the Site:
- You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and distribute that content in connection with operating and promoting the Site.
- You warrant that you own or control all rights to such content and that it does not infringe any third-party rights or laws.
- You remain solely responsible for the legality, accuracy and appropriateness of your content.
- My Korean Kitchen reserves the right to monitor, edit or remove any of this content, this will usually be done only if it violates the above prohibited uses.
If you believe that any content on the Site infringes your copyright, please contact us at contact at mykoreankitchen.com with a takedown request including all information required by law (for example, DMCA-style notice). We may remove or disable access to such content as appropriate.
9. Links to Other Sites & Third-Party Services
The Site may contain links to third-party websites, services or content.
These are provided for your convenience and do not imply endorsement or approval.
We do not control third-party sites and are not responsible for their content, services, acts or omissions, to the maximum extent permitted by law.
Your dealings with third-party providers (including advertisers, payment processors, delivery partners or other service providers) are solely between you and those third parties. We disclaim liability for any loss or damage arising from such dealings.
10. Termination / Suspension
We may suspend or terminate your access to the Site at any time, with or without notice, if you breach these Terms or any applicable law.
Upon termination, all rights granted to you under these Terms cease immediately.
Provisions which by their nature should survive – such as ownership, disclaimers, limitation of liability, indemnification, dispute resolution and confidentiality – will continue after termination.
11. Limitation of Liability
To the maximum extent permitted by applicable law, My Korean Kitchen, its affiliates, licensors and service providers will not be liable for any indirect, incidental, special, punitive or consequential damages, including loss of profits, data, business, goodwill or reputation, even if advised of the possibility of such damages.
Our aggregate liability to you for all claims under these Terms – whether in contract, tort (including negligence), statute or otherwise – is limited to the greater of:
1. the total amount you paid to us in the six (6) months immediately before the claim; or
2. AUD $100 (or equivalent).
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by our negligence,
- fraud or wilful misconduct,
- breach of any non-excludable statutory guarantee under the ACL,
- or any other liability which cannot be excluded or limited by law.
12. Indemnification
You agree to indemnify, defend and hold harmless My Korean Kitchen, its officers, directors, employees, agents, affiliates, licensors and service providers from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:
- your breach of these Terms,
- your misuse of the Site,
- your violation of any law or third-party rights, or
- any User Content you submit or make available through the Site.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification. You agree to cooperate in our defence of such claims.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict-of-law principles.
You submit to the exclusive jurisdiction of the courts of Queensland, Australia, except as provided in the Dispute Resolution clause below.
14. Dispute Resolution / Arbitration
Notice and Negotiation:
Before starting arbitration or court proceedings, you must send us written notice of the dispute to PO Box 948, Aspley, QLD 4034, Australia or contact at mykoreankitchen.com describing the nature of the dispute. Both parties agree to negotiate in good faith for at least 30 days to try to resolve the matter.
Arbitration:
If the dispute is not resolved within 30 days of notice, it must be referred to binding arbitration administered by the Australian Centre for International Commercial Arbitration (ACICA) under its rules in force at the time.
The seat of arbitration shall be Brisbane, Queensland, Australia.
The arbitration shall be conducted in English by a single arbitrator, unless the parties agree otherwise.
The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
No Class Actions:
Arbitration must proceed on an individual basis – class, collective or representative actions are not permitted.
Court Relief:
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief in a court of competent jurisdiction, for example to protect intellectual property or confidential information.
This clause survives termination or expiration of these Terms.
15. Time Limit to Bring Claims
To the maximum extent permitted by law, any claim or cause of action you may have arising from or relating to the Site or these Terms must be commenced within one (1) year after the cause of action accrues (that is, the date when you knew or ought reasonably to have known the facts giving rise to the claim).
After that period, the claim is permanently barred, unless a longer statutory limitation period applies.
16. Modifications to Terms
We may modify these Terms at any time.
When we make material changes, we will update the “Effective Date” at the top of this page and, where reasonably practicable, provide at least 30 days’ notice before the changes take effect.
If you continue to use the Site after the revised Terms become effective, you agree to be bound by the new Terms.
If you do not agree to the revised Terms, you must cease using the Site.
17. Notices
All notices required or permitted under these Terms must be in writing.
We may deliver notices by:
- posting them on the Site (effective on posting),
- emailing you at the last email address you provided (effective on sending), or
- registered or certified mail to your postal address (effective 5 business days after posting).

18. Severability & Entire Agreement
If any provision of these Terms is held invalid, illegal or unenforceable by a court or tribunal, that provision shall be severed or limited to the minimum extent necessary so that the remainder of the Terms continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Korean Kitchen regarding your access to and use of the Site, and supersede all prior or contemporaneous agreements, proposals or communications, whether written or oral, relating to the same subject matter.
19. E-commerce (If Applicable)
Due to the international readership of My Korean Kitchen, all prices are shown in US Dollars unless stated otherwise.
You agree to pay all applicable charges, taxes, customs duties and delivery fees.
All sales, refund, and shipping policies will be detailed on the relevant product pages or at checkout and form part of these Terms.
20. No Waiver
Our failure or delay in enforcing any right or provision of these Terms shall not constitute a waiver of that right or provision.
21. Force Majeure
We will not be liable or responsible for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, acts of God, government action, strikes, internet or power outages, or failures of third-party service providers.
22. Assignment
We may assign or transfer our rights and obligations under these Terms to another entity or affiliate at any time.
You may not assign or transfer your rights or obligations without our prior written consent.
23. International Use
We make no representation that the Site or its content is appropriate or available for use in every jurisdiction.
You are responsible for compliance with local laws where you access the Site.
24. Electronic Communications Consent
You consent to receive communications from us electronically (for example, via email or by posting notices on the Site).
These electronic communications satisfy any legal requirement that communications be in writing.
25. Reservation of Rights
We reserve the right to modify, suspend or discontinue any aspect of the Site or Services at any time without liability, subject to applicable law.
26. Survival of Provisions
Any provisions of these Terms which by their nature should survive termination – including but not limited to intellectual property rights, disclaimers, limitation of liability, indemnification, dispute resolution, and confidentiality – shall continue to apply after termination or expiration of these Terms.
